Naming an Executor (Please identify an Executor even if you elect to draft a Living Trust).
The "Executor" of your estate is the person, persons or corporation that you appoint to assist the court in carrying out the provisions in your Will. Your executor will assist the court and the probate attorney in identifying your assets as well as identifying your beneficiaries, family members, etc. An Executor is necessary for both a Will and a Trust. Typically, spouses/partners are the initial Executors for each other, then an alternate is named.

II. Trustees (only for estate plans that include a Trust)

The Trustee is the individual or entity that will have control over your assets. Initially, YOU will be the Trustee so you will always have ownership and control over your assets prior to your passing. Upon your passing (or mental incapacity), the terms of your Trust become un-changeable. However, you will need someone who will ensure the distribution of your assets as you have directed them to be in your Trust. It is not nearly as daunting a task as it sounds and there are ways that you can simplify the duties of the Trustee even more.
